 Section 32 of the Constitution

Comply with Section 32 for access to information.

Section 32 of the Constitution deals with the right of access to information and it provides that everyone has the right of access to any information that is held by the State; as well as any information that is held by another person that is required for the protection of any rights.

The Promotion of Access to Information Act 2000(PAIA) gives effect to Section 32 of the Constitution that is subject to justifiable limitations including, but not limited to the following:

  • Limitations aimed at the reasonable protection of privacy;
  • Commercial confidentiality;
  • And efficient and effective governance.

These limitations are set in a manner which balances the right of access to information with any other rights including the rights featured in the Bill of Rights in Chapter 2 of the Constitution.
